    Thanks. I like your idea;A better place for that would be any country where expatriates work in the Middle East ( Saudi Arabia, Dubai, Kuwait, Qatar, Oman etc)
    I think if there is no time limit ( currently 6 years) on h1 visa and there are 3 yr extensions, it will make all of our lives so much easier.

    There will be no hurry to apply for GCs and those who really want to stay in US forever will apply, thus reducing all this backlogs too.

    Any thoughts.

    I am from health care industry and have a bachelors degree. My GC has been initiated under Eb3 category. We do not need the PERM process so an I 140 will be filed once the prevaling wage determination is cleared by the DOL. Recently I learnt that though I have the bachelors degree it is equivalent to the masters degree of my profession. I have a document stating the same from the board who is responsible for licensing.
    My question is that since my process is already initiated in EB3 can i also start it under EB2? Do i have to withdraw the earlier EB3 if i want to proceed with EB2? Please let me know if that is allowed or not.

    Hi,
    One of my friends is saying Job experience with the same company would not count towards? So this means will i have to change jobs and hope that my I-140 for the current employer is not withdrawn. Pl. advise.

    The job experience from the same company can only be counted if the employer can prove the new job is atleast 50 % different from the current job. Please consult a lawyer before making the decision. The difference should be in job duties and not simply a move between two projects.

    HI ,
    MY H1 b is expiring on 30 Sep ,2009 .

    My current client informed me that they are going to hire me as a fulltime , but it will take 2-3 months for them to hire me .

    Should I ask my current employer to file H1 extention right now ?

    Or I should wait for H1 trnsfer as a fulltime employee ?

    Any suggestions ?

    Reg. ques 2 - Let me rephrase it

    This is my wife's first H1B which is valid for 3 years ( started in Oct 2005 - Oct 2008). If she does COS to H4 now (June 2008) and if she plans to COS to H1 next year (Lets say March 2009), then will her new H1 application still be considered against the H1B cap (cos her first h1b must have expired in Oct 2008)?

    Where can I find the 2005/2006 Memo ?

    I am living in US and am currently on AOS (Adjustment of Status), my mom is staying with me on tourist visa but her visa expires in middle of June this year. Last year my father expired and my mother is incapable of taking care of herself alone (she is suffering from pysio frania which basically means she fears strangers and repeats stuff) so i would like to apply for Visa extension for her. Can anyone suggest what points i should take care of while applying for Visa extension for her? or is there any visa under which i can have stay with me in US as dependent??

    looking at the worst side, wat if the H1 tranfer Denied/rejected. Can i ask Company D to file for a new H1?

    Now because all embassies and consulates required to use PIMS to verify your H1B status... sometimes takes several weeks to get the passport stamped. In my case takes 3 weeks after interview to get my passport back (embassy at Lima, Peru).

    So beware of the timing

    I just bring a copy of my wife H1B approval and copy of lasts taxes ... just in case

    What is your qualification?
    Masters or Bachelor with 5 years of experience?
    It may be safer to apply EB3 than EB2, if you don't have a strong case.

    Hi All,

    I applied for Labor in EB2 category in Oct 2007. It was pending for 2 yrs and 2 days back my employer mentioned that they see my Labor status as denied and that they have not received any denial letter yet.

    My H1 will expire in early Jan 2011, so I practically have around 365 days from now to apply for a new Labor. My questions are

    1. Should I re-appeal?
    2. Do Labors get approved in re-appeal?
    3. Can I start a new Labor application with the same employer simultaneously?
    4. What�s a safe category to apply at this point in time. EB2 or EB3?

    That's great news - IV's efforts are paying off now. Not sure if they give two years for all EAD's applications (either renewal or new) that are currently pending. Now I wish my application will get a bit delayed in processing :)

    Anyway its a good news that they are starting it from June end.

    Well i missed the boat atleast for this yr..:(
