In that case may be for CP 22 Feb 2002 will be considered as cut off date & for AOS USCIS bulletin date will be considered. --
USCIS does not publish a different bulletin. Only the Dept. of State publishes the bulletin and this is used by both the embassies for CP cases and by USCIS for AOS cases.

Hi
I came to us on H4 in 2007 and the got my H1B in 2008. I am not getting a job on H1 yet so i want to know that till when the H1B be valid as I am not genarating any salery and my consultant is not running my pay roll ?
And if the H1 goes dorment then what can be done next?
H1 would be valid/active the moment you accept employment with H1-B sponsoring employer.
Since you haven't started working and assuming you haven't accepted the offer from the
H1 sponsoring employer, YOU should be fine.
Please take advise from your company attorney.

Given that you filed in Dec 2002, it is very possible that your labor petition has already been certified or at least adjudicated.
You need to talk to your company/HR and get this resolved. Impress on them the importance of knowing the status of your petition.

Getting name change while you are on Indian passport is a lot cheaper and easier than getting it done on US passport.
You get the name changed in Indian passport. Then you need to get a new I797. USCIS notifies SSA, who will issue you a new SSN card (you cannot get ssn changed directly).
I am not sure how much of this is an issue with GC process.

My opinion - Check this with a lawyer. Seems to be complicated. Not sure if there is anything against the law done by you /your company (that affects you). Thats why the need for a good lawyer to understand the details in the case. All the best!!!

I got a NOID because my 140 was withdrawn by my employer, if your 140 is not withdrawn then you must be ok. The problem I have is, I had filed AC21 even before the 140 withdrawal but not after a year after its withdrawal, I am getting a NOID.
I am just disappointed by their carlessness before sending a NOID. If they had see my documents, they would have found my AC21 as I had added it along with my RFE response. Anyway not much I can do other than responding back with a new AC21. I wanted to see if there is a pattern to this pattern.
